These Terms govern your use of the Morsable app for iPhone and the website at morsable.com, operated by Morsable, an individual entrepreneur registered in Georgia (the country, not the US state). By creating an account or using the service you agree to them. If you do not agree, do not use Morsable.
Who may use Morsable
You must be at least 13 years old, or older where your country sets a higher age for consenting to online services. By using Morsable you confirm that you meet this requirement and that you are not barred from using it under any applicable law.
Your account
You are responsible for what happens under your account and for keeping access to it secure. Tell us promptly at support@morsable.com if you believe someone else is using it.
Content you share
You keep ownership of the messages, photos and other content you create. To run the service, you grant us a limited, worldwide, non-exclusive, royalty-free licence to host, store, transmit and display that content for the purpose of operating and providing Morsable. This licence ends when the content is deleted, except for copies retained in routine backups or where we must keep something to comply with the law or to address abuse.
You confirm that you have the rights to the content you share and that it does not infringe anyone else's rights.
Zero tolerance for objectionable content and abusive behaviour
Morsable includes messaging and live Morse sessions between users. There is no tolerance for objectionable content or for abusive users. You must not use Morsable to:
- harass, threaten, bully, stalk or intimidate anyone;
- share sexual content involving minors, or any content that sexualises a minor, under any circumstances;
- share pornography, graphic violence, or content that is otherwise obscene;
- promote hatred or violence against people on the basis of race, ethnicity, national origin, religion, disability, sex, gender identity, sexual orientation or age;
- impersonate another person or misrepresent who you are;
- share someone else's private information without their permission;
- send spam, scams, malware, or unsolicited advertising;
- attempt to access accounts, data or systems you are not authorised to access, or to disrupt the service;
- use the service for any unlawful purpose.
Reporting, blocking and moderation
Every user can block another user and report content or behaviour from within the app. We review reports of objectionable content and abusive behaviour and act on them within 24 hours, which may include removing content, suspending the account responsible, or removing it permanently.
We may remove content or suspend or terminate accounts where we reasonably believe these Terms have been broken, or where it is necessary to protect users. Where it is appropriate and lawful to do so, we will tell you why.
Live Morse sessions
The app can connect two people for a live Morse session, in which taps are transmitted as timing signals and played back as tones on each device. No audio or video is captured or transmitted. Everything in the section above applies to conduct during a live session just as it does to messages.
Morse code is not an emergency service
Morsable is an educational and social app. It is not an emergency communication system and must not be relied on in an emergency. Learning material about distress signals, including SOS, is provided for general information only. In an emergency, contact your local emergency services by the normal means. We accept no liability for reliance on Morsable in an emergency.
Availability and changes
We may change, suspend or discontinue any part of Morsable, and we may impose limits on features. We aim to keep the service running but do not promise uninterrupted or error-free operation.
Disclaimer
To the fullest extent permitted by law, Morsable is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.
Limitation of liability
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential or punitive damages, nor for any loss of data, profits, goodwill or opportunity, arising out of or relating to your use of Morsable. This includes harm arising from the conduct of other users, whether online or offline.
Where liability cannot lawfully be excluded, our total liability for all claims relating to the service is limited to the greater of the amount you paid us in the twelve months before the claim, or fifty United States dollars.
Nothing in these Terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited under applicable law. If you are a consumer, you keep the statutory rights your local law gives you.
Indemnity
You agree to indemnify and hold harmless the operator of Morsable against claims, losses and reasonable costs arising from content you share, from your use of the service, or from your breach of these Terms, except to the extent the claim results from our own wrongdoing.
Governing law
These Terms are governed by the laws of Georgia (the country), and the courts of Georgia have jurisdiction over any dispute. If you are a consumer resident elsewhere, this does not deprive you of the protection of mandatory consumer law in your country of residence, or of the right to bring proceedings there where your local law gives you that right.
Apple App Store terms
The following applies when you obtain Morsable from the Apple App Store:
- These Terms are between you and the operator of Morsable, not with Apple. Apple is not responsible for Morsable or its content.
- Your licence to use Morsable is limited to a non-transferable licence to use it on Apple-branded devices you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
- Apple has no obligation to provide maintenance or support for Morsable.
- If Morsable fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to Morsable.
- The operator, not Apple, is responsible for addressing any claims relating to Morsable, including product liability claims, claims that it fails to conform to a legal requirement, and claims under consumer protection or similar law.
- The operator, not Apple, is responsible for the investigation and defence of any third-party claim that Morsable infringes intellectual property rights.
- You confirm that you are not located in a country subject to a US Government embargo or designated as a terrorist-supporting country, and that you are not on any US Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
Changes to these Terms
We may update these Terms. If a change is material we will update the date at the top and, where the change is significant, notify you in the app. Continuing to use Morsable after a change means you accept the updated Terms.
